IMPLEMENTASI UNDANG – UNDANG NOMOR 23 TAHUN 2007 TENTANG PERKERETAAPIAN MENGENAI LARANGAN MENDIRIKAN BANGUNAN DI SEMPADAN REL KERETA API SURABAYA

Abstract


Keterbatasan lahan membuat harga jual menjadi mahal yang mengakibatkan penduduk yang ekonominya rendah tidak mampu membelinya, sehingga akhirnya mereka memilih tinggal ditempat sesuai kemampuan, seperti di sempadan rel kereta api. Adanya bangunan seperti permukiman di sempadan rel kereta api tersebut dinyatakan telah melanggar aturan Perkeretaapian. Oleh karena itu, harus ada upaya mengenai pelaksanaan larangan Pasal 178 Undang - Undang Nomor 23 Tahun 2007 tentang Perkeretaapian. Dalam pelaksanaan larangan tersebut masih mengalami beberapa hambatan dikarenakan padatnya bangunan, minimnya kesadaran warga dan permintaan ganti rugi. Sehingga tujuan penelitian ini adalah 1) untuk menganalisis bagaimana pelaksanaan larangan Pasal 178 Undang – Undang Nomor 23 Tahun 2007 tentang Perkeretaapian mengenai larangan mendirikan bangunan di sempadan rel kereta api, khususnya di kelurahan Ngagel kota Surabaya. 2) Untuk menganalisis hambatan apa yang dihadapi oleh PT. KAI Daop 8 Surabaya terkait pelaksanaan Pasal 178 Undang – Undang Nomor 23 Tahun 2007 tentang Perkeretaapian. Metode penelitian yang digunakan adalah metode penelitian yuridis empiris. Data dikumpulkan dengan menggunakan teknik wawancara dan studi dokumen. Data primer diperoleh secara langsung dengan observasi, wawancara kepada pihak PT. KAI Daop 8 Surabaya dan warga di sempadan rel kereta api kelurahan Ngagel dan dokumentasi, sedangkan data sekunder diperoleh dari studi kepustakaan, yaitu berupa literatur, jurnal, internet dan perundang – undangan yang berkaitan. Teknik analisis data dilakukan dengan pengumpulan data, reduksi data, penyajian data dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa pelaksanaan penerapan Pasal 178 Undang – Undang Nomor 23 Tahun 2007 tentang Perkeretaapian belum berjalan dengan baik, namun tetap dilakukan penertiban oleh pihak PT. KAI setelah memberikan peringatan atau pemberitahuan sampai beberapa kali. PT. KAI akan sosialisasi dahulu kepada warga mengenai penertiban tersebut. Penertiban dilakukan dengan bertahap dan dilakukan dengan dua jenis penertiban, yaitu penertiban sistem administrasi dan system pengosongan. Faktor yang menjadi penghambat terkait pelaksanaan penerapan larangan Pasal 178 Undang – Undang Nomor 23 Tahun 2007 tentang Perkeretaapian adalah padatnya bangunan di sempadan rel, minimnya kesadaran warga yang tinggal di sempadan rel dan permintaan ganti rugi yang diminta oleh warga. 1) Diharapkan bagi pihak perkeretaapian seharusnya lebih meningkatkan mengenai pengawasan terhadap perlindungan sempadan rel kereta api. 2) Bagi pihak masyarakat harus lebih memahami aturan pendirian bangunan yang telah berlaku, khususnya dalam pendirian bangunan di sempadan rel kereta api. Therefore, There should be an attempt on the implementation of the prohibition of Article 178 of Law Number 23 Year 2007 concerning the railways. In the implementation of the ban is still experiencing some obstacles due to density of buildings, the lack of awareness of citizens and demand for compensation. So the purpose of this research are 1) To analyze how the implementation of Article 178 Law Number 23 Year 2007 concerning the railways about prohibition establishing building on railroad border, especially in ngagel district, city of surabaya. 2) To analyze the obstacle that face by PT. KAI Daop 8 Surabaya related to implementation of Article 178 Law Number 23 Year 2007 concerning the railways. The research method used is empirical juridical research method. Data were collected using interview techniques and document studies. Primary data is obtained directly by observation, Interview to PT. KAI Daop 8 Surabaya and inhabitant that live in railroad border district Ngagel and documentation, while secondary data is obtained from literature study, namely in the form of literature, journals, internet and related legislation. Data analysis technique is done by data collection, data reduction, data presentation and conclusion. The results show that implementation of article 178 of Law Number 23 Year 2007 concerning the railways not going well, but the control is still done by the PT. KAI after giving warning or notice several times. PT. KAI will first socialize to the citizens about the curbing. Controlling is done gradually and done with two types of curbing, namely the control of the administrative system and the discharge system. Factors that become obstacles related implementation article 178 of Law Number 23 Year 2007 concerning the railways are dense building on railroad border, lack of awareness of citizens that lives on railroad border and Requests for compensation by inhabitant. It is expected that the railways side should improve on the protection of railway border protection. For the inhabitant should be more understanding about the rules of construction and existing buildings, especially in the construction of buildings on the railroad border.
